Gossip Girl star Kelly Rutherford’s nasty divorce/custody battle spilled into an LA courtroom this morning, where Rutherford asked the judge permission to take the ex-couple’s two-year-old son Heremes with her to NYC when she starts filming this Sunday.
Rutherford’s estranged husband Daniel Giersch says her long work hours drive their son wild when he’s in NYC and is seeking the judge to order Hermes to stay with him in LA.
According to reports, the judge decided he would make his decision tomorrow. If he says no, Rutherford will have to choose wether to jet off to NYC without the boy, or pull herself out of the show for family.
Hopefully Judge has a daughter or neice who just loves the character of Lily VanDerWoodsen.
